This application for anticipatory bail, arises out of Complaint Case No. 90 of 2017, disclosing offences punishable under Sections 465, 467, 468 and 120B of the Indian Penal Code.

Learned counsel for the petitioner has drawn my attention to Annexure-2/1 to the writ application, to submit that wife of the petitioner, namely, Baby Devi, who is a co-accused and in whose favour the registered sale deed was allegedly fraudulently executed, has been granted anticipatory bail by this Court by order dated 21.08.2018 passed in Criminal Misc. No.

Patna High Court CR. MISC. No.27256 of 2019(4) dt.30-04-2019 2/2 47913 of 2018. He contends that the petitioner has been implicated because he is husband of Baby Devi. Considering the facts and circumstances, as noted above, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of Smt. Rachna Raj, A.C.J.M.-XII, Vaishali at Hajipur in connection with Complaint Case No. 90 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
