====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-07-2022 Heard learned counsel for the parties.

The petitioners apprehend their arrest in a case registered for the offence under Sections 363 / 365 of the Indian Penal Code.

F.I.R. was lodged against unknown for missing of the brother of the informant. During investigation, name of petitioners and others transpired on the basis of CDR location of their mobile phones, which was found near the CDR location of the victim.

It is submitted on behalf of petitioners that only on suspicion, petitioners have been made accused. Except

Patna High Court CR. MISC. No.37908 of 2021(3) dt.28-07-2022 2/2 suspicion, there is no other tangible evidence to show complicity of petitioners in the aforesaid crime. Petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 15, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 254 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
