The petitioner seeks pre-arrest bail in connection with Bihta P.S.Case No. 655 of 2017 registered under Sections 341, 323, 354 and 34 of the Indian Penal Code. It is stated by the learned counsel for the petitioner that a false and fabricated case has been filed by the informant out of enmity existing from before between the parties. He submitted that the other co-accused persons named in the FIR have already been granted pre-arrest bail by the court below. On the other hand, learned counsel for the State submitted that it is the petitioner who is alleged to have teased the informant while she had gone out to attend the call of nature.

No.58027 of 2017 (2) dt.20-12-2017 2/2 Be that as it may, regard being had to the statement made on oath that the petitioner has got no criminal antecedent, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in connection with Bihta P.S.Case No. 655 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
