JUSTICE PARTHA SARTHY ORAL ORDER 29-07-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has renewed his prayer for bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the petitioner was driver of the vehicle from which the illicit liquor was recovered. It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 9.12.2020 (Annexure-1) giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 20.6.2020 and has no criminal antecedent.

No.38412 of 2021(2) dt.29-07-2021 2/2 Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order together with the petitioner having remained in custody for over one year, the Court directs the petitioner to be enlarged on bail in connection with G.O. Case no. 89 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Nawada.
