No. 1999 of 2002 was disposed of along with various other cases and directions were issued to the Secretary-cum-Commissioner, Health Department, Government of Bihar, Patna to consider/reconsider the matter and decide the representation of the petitioner and various other employees as directed in the order in question passed in the writ petitions on 27.07.2007. Inter alia contending that till filing of the application on 22nd of December, 2014 no action has been taken, this application has been filed.

Keeping in view the fact that the petitioner has now retired and the matter pertains to settlement of her service benefit

Patna High Court MJC No.4895 of 2014 dt.20-07-2017 2/2 including pensionary claims is still pending, in case the matter has not been decided with regard to payment of emoluments, salary and other benefits to the petitioner, the competent authority as directed on 27.07.2007 shall consider the same and decide it in accordance with law within a period of three months from the date of receipt/production of certified copy of this order. The amount due and found payable, as already directed, should be paid to the petitioner within a period of two months thereof.

With the foresaid direction, the contempt application stands disposed of.
