JUSTICE BIRENDRA KUMAR ORAL ORDER 04-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 364 of the Indian Penal Code.

The petitioner is under suspicion to have abducted the father of the informant.

Submission of the petitioner is that neither the petitioner had called the father nor there is any motive alleged for abduction nor he had gone along with the father of the informant which would be evident from the FIR itself.

There is no other material in the case diary as informed by learned counsel for the State.

Let the petitioner, above named, in the event of his

Patna High Court Cr.Misc. No.53044 of 2016 (5) dt.04-05-2017 2/2 arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura/successor Court in connection with Madhepura Police Station Case No. 281 of 2016, G.R. No. 826 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
