In this case, the petitioners are seeking anticipatory bail in connection with Ariyari (Kasar) P.S. Case No. 170 of 2012 registered for offence punishable under sections 420, 120(B)/34 of the Indian Penal Code and 47 (a) of the Excise Act.

The FIR has been lodged in the year 2012, but the petitioners are coming after six years, is ground for rejection of the anticipatory bail.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners and

Patna High Court CR. MISC. No.26795 of 2019(2) dt.24-04-2019 2/2 accordingly their prayer for bail is rejected. However, if the petitioners surrender and pray for regular bail, the court below will take decision in accordance with law.
