The petitioner seeks regular bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 146 of 2021, registered under Sections 25(1-b) A/26(i) (ii), 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 06.03.2021, is a person of clean antecedent, charge-sheet has been submitted. Learned counsel further submits that the informant in the F.I.R. alleges that he had secret information that arms smugglers are going by Train to Kolkata, accordingly, a team was constituted under the railway bridge of Lakhisarai vehicle checking started it has alleges that six persons on two motorcycle came including the

No.38140 of 2021(2) dt.13-12-2021 2/3 petitioner they tried to flee away but caught by police party and they disclosed their name and from possession of Ajit Sarkar one country made pistol,one katta alongwith a magazine of 6 cartridges, one mobile and cash of Rs. 370 have been recovered whereas from Mithilesh Kumar altogether 7 country made pistols alongwith 64 cartridges have been recovered. Learned counsel for the petitioner submits that from the perusal of the allegation as alleged in the F.I.R. it would manifest that nothing was recovered from the possession of the petitioner and he has made accused merely because he was accompanying the accused persons.
Learned counsel further submits that similarly situated co-accused Udlesh Kumar has been granted bail by order dated 06.12.2021 in Cr. Misc. No. 36519/2021.
Learned APP for the State opposes the prayer of regular bail application of the petitioner.
Considering the fact that the petitioner is in custody since 06.03.2020, charge-sheet has been submitted in this case and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief
