09-11-2017 Heard Sri Krishna Kant Singh, learned counsel for the petitioner and Sri Nityanand, learned Addl. Public Prosecutor. The sole petitioner, who is a lady and wife of accused in the present case apprehending her arrest in G.B.Gagar P.S. Case No. 136 of 2017 registered for offence under Sections 272, 273, 308 of the Indian Penal Code and Sections 34, 36, 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of her arrest or surrender. It was submitted by learned counsel for the petitioner that it is true that petitioner is wife of one Vinod Chaudhari and from the said accused, recovery of about 5 liter of Mahua liquor was shown and petitioner, being wife of Vinod Chaudhari, has been made accused. He further submits that her husband Vinod Chaudhari has already been granted regular bail by the court

Considering the fact that petitioner is wife of an accused, from whose house small quantity of Mahua liquor was shown recovered, there is no reason to refuse the prayer for anticipatory bail.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Urmila Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with G.B.Nagar P.S. Case No. 136 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
