The petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 131 of 2019 registered under Section 30(a) of the Bihar Excise Prohibition Act, 2016 pending in the Court of Special Judge, Excise Act, Gaya. Submission is that petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of this petitioner. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that huge quantity of country made liquor has been recovered from the house of the petitioner. Hence, he does not deserve privilege of anticipatory bail.
Patna High Court CR. MISC. No.25516 of 2019(4) dt.10-07-2019 2/2 Having considered the above facts and circumstances of the case, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
