JUSTICE PARTHA SARTHY ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Sono P.S Case no. 24 of 2020 registered under sections 3 and 4 of the Explosive Substances Act.

As per allegation in the FIR, it is stated that on being asked to stop their motorcycle the three accused persons made an attempt to escape. While one accused managed to escape, Ram Khelawan Yadav and one Mantu Manjhi were arrested and on search 500 grams of explosive substance was recovered. It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are false and concocted and no incriminating article has been recovered from the possession of the petitioner. The petitioner has no concern either

Patna High Court CR. MISC. No.28260 of 2020(2) dt.02-12-2020 2/2 with the motorcycle or with the alleged explosive substance. It is submitted that the case of the petitioner stands on a similar footing to that of co-accused Mantu Manjhi who has been enlarged on bail by order dated 12.10.2020 (Annexure-3) passed in Cr. Misc no. 26013 of 2020. The petitioner has no criminal antecedent and is in custody since 31.1.2020. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner being in custody since 31.1.2020 and grant of bail to co-accused Mantu Manjhi, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Sono P.S. Case no. 24 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui.
