JUSTICE ANIL KUMAR SINHA ORAL ORDER 29-09-2020 Heard Mr. Ravindra Kumar Singh, learned counsel for the petitioner and Mr. Madhura Nand Jha, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner apprehends his arrest in connection with Rajnagar PS Case No. 401/2018 registered for the offence punishable under Sections 414, 120(B) IPC and 46 of the Prisoners Act.

3. The allegation against the petitioner is that while the petitioner was in custody in connection with other case, a raid was conducted in the jail premises and a Samsung Mobile phone was recovered from possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case with oblique motive. Learned counsel, referring to para-9 of this application, submits that at the time of raid, the petitioner was one of the prisoners in the ward and was already under custody and he was not remanded in the present case at that point of time.

5. Learned counsel further submits that the petitioner

Patna High Court CR. MISC. No.24328 of 2020(2) dt.29-09-2020 2/2 has been released in other case and now he apprehends arrest by the police in the present case.

6. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the police did not take the petitioner in remand while he was in custody, I am inclined to grant anticipatory bail to the petitioner.

7. Accordingly, petitioner, PARNAMI SINGH @ KRISHNA KUMAR SINGH shall be released on anticipatory bail, in the event of his arrest or surrender within six weeks, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Madhubani in connection with Rajnagar PS Case No. 401/2018, subject to the conditions as laid down under Section 438(2) CrPC.

8. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
