JUSTICE PRABHAT KUMAR JHA ORAL JUDGMENT Date: 23-08-2017 Heard Mr. Awadhesh Kumar, learned counsel for the petitioner and Mr. Madhav Prasad Yadav, learned GP 23. The petitioner has preferred this writ petition against the order of his suspension as contained in Memo No. 134 (4) dated 13.02.2014 (Annexure-8). During pendency of this writ petition, departmental proceeding was initiated against the petitioner and the petitioner has already been suspended but, since there was an order that no final order shall be passed against the petitioner in the departmental proceeding, the final order of dismissal is kept in abeyance.

Patna High Court CWJC No.6963 of 2014 dt.23-08-2017 Learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition with liberty to file representation stating all the facts with regard to acquittal in criminal case and the disciplinary authority shall consider the petition of the petitioner before passing the final order which is kept in abeyance. Prayer is allowed.
