JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2018 Petitioner apprehends his arrest in connection with Industrial Area P.S.Case No. 93 of 2017 registered for the offences under Sections 467, 468, 469, 471, 414 of the Indian Penal Code and Sections 30 and 37 of the Bihar Prohibition and Excise Act, 2016.

Allegation as per FIR is that police intercepted one Bolero vehicle and on chase three persons were arrested. However, two persons succeeded in fleeing away and petitioner has been named by the arrested co-accused and there is huge recovery of wine from the Bolero vehicle.

Submission of learned counsel for the petitioner is that except disclosure of his name by co-accused there is nothing against him and his house was raided and nothing was recovered

Patna High Court Cr.Misc. No.3730 of 2018 (2) dt.05-02-2018 2/2 from his house and though he is accused in such type of case in the year 2013 under old Act and under the new Act no case is pending against him.

In the facts and circumstances, let the petitioner, above named, surrender within a period of six weeks and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II-cum-Special Judge, Vaishali, Hajipur, in connection with Industrial Area P.S.Case No. 93 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation of the case and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
