JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Begusarai Town P.S. Case No. 393 of 2016 registered under Section-414 of the Indian Penal Code.

The wife of the petitioner was caught in a vehicle, from which, in huge quantity, bottles of Indian made foreign liquor were recovered. The wife of the petitioner disclosed the name of the petitioner just after her arrest and stated the involvement of the petitioner in the alleged crime. Considering the above-said facts and circumstances of the case as well as submission of the parties, I do not think it proper to extend the privilege of anticipatory bail to the petitioner

Patna High Court Cr.Misc. No.54610 of 2016 (2) dt.10-01-2017 2/2 and accordingly, his prayer for anticipatory bail in connection with Begusarai Town P.S. Case No. 393 of 2016 stands rejected. However, this order shall not cause any prejudice to the competent court at the time of consideration of regular bail application of the petitioner.
