The petitioners seek anticipatory bail in a case instituted for the offence under Sections 147, 148, 149, 323 and 307 of the Indian Penal Code.

It is alleged that on the date of occurrence the other accused persons assaulted the nephew of the informant with lathi and danda and when the informant went to rescue him, the petitioner assaulted the informant with lathi and Garansi on the head causing injury on the head and also on the left finger. Case diary has been received. Learned A.P.P. has pointed out about the injury in paragraph-27 of the case diary

Patna High Court Cr.Misc. No.27 of 2017 (4) dt.09-02-2017 2/2 wherein the doctor has found as many as six injuries on the scalp of the informant caused by a hard and blunt substance. In such circumstances, this Court does not find it a fit case for anticipatory bail.

The prayer for anticipatory bail of the petitioners stands rejected.

The petitioners are directed to surrender before the court below and pray for regular bail which shall be considered by the court below in accordance with law after looking into the fact that that there is simple injury on the person of the informant, without being prejudiced by this order.
