Smt. Renu Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Dalsingsarai P.S. Case no. 02 of 2018, registered under Sections 307, 323, 341 and 504/34 of the Indian Penal Code.

The accusation is that on 01.01.2018 at about 2.00 P.M. the informant, Mohni Devi, was at her door, at that time Sunil Kumar Sahni came near her and started to abuse. In the meantime, petitioners along with Sachin Sahni armed with

Patna High Court Cr.Misc. No.28713 of 2018(2) dt.10-05-2018 2/2 Lathi, Farsa, Garasa etc. came there and started to cause assault to the informant brutally. On raising hulla, the neighbours came there then all fled away giving threatening of dire consequences to her family.

Learned counsel for the petitioners submits that, in fact, the informant is Chowkidar and she is next door neighbour of the petitioners and due to dispute in between the informant and Sunil Kumar Sahni, the petitioners have also been implicated in the present case without any specific overt act. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Dalsingsarai in connection with Dalsingsarai P.S. Case No. 02 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
