The petitioner seeks bail in connection with Bakhri P.S. Case No. 266 of 2017 for the offence under Sections 366A of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the F.I.R. has been lodged after lapse of five days from the date of alleged occurrence without any plausible explanation. Moreover, the father and mother, who have also been implicated in this case, have been granted anticipatory bail by a co-ordinate Bench of this Court. Further, in the

Patna High Court CR. MISC. No.24968 of 2020(3) dt.10-11-2020 2/2 statement recorded under Section 164 Cr.P.C., the specific allegation is attributed to the co-accused Radhey Shyam and no specific overt act is attributed to the petitioner. The petitioner is rotting in judicial custody since 29.02.2020. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned A.C.J.M., Begusarai in connection with Bakhri P.S. Case No. 266 of 2017.
