2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 364, 302, 201 and 34 of the Indian Penal Code.
3. The case of the prosecution is that Janardan Tanti has taken away the son of the informant. When he did not return, he was being searched and Janardan Tanti was enquired but he did not disclose anything. On 18.03.2024, the informant received information that a dead body is lying and when he went there, he found the body of the deceased. The informant suspected that Kundan Tanti, Janardan Tanti, Rudal Tanti and R.K. Tanti might have killed his son.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.28990 of 2026(2) dt.06-05-2026 2/3 petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the name of this petitioner is not there in the FIR. His name has surfaced during course of investigation in the confessional statement of coaccused Kundan Tanti who has already been granted bail by learned co-ordinate Bench of this Court vide Cr. Misc. No. 32568 of 2025. Learned counsel has submitted that the deceased was having illicit relationship with his own cousin sister due to which, his own family members got annoyed and finally they might have killed the deceased. The killing of the deceased appears to be a case of honour killing. In this regard, the informant's own statement mentioned in the case diary at paragraph no. 65 may be perused. Learned counsel has submitted that save and except, confessional statement of coaccused, there is nothing against this petitioner. Moreover, the petitioner is languishing in judicial custody since 23.12.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with
Patna High Court CR. MISC. No.28990 of 2026(2) dt.06-05-2026 3/3 Kharagpur P.S. Case No. 97 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Munger. (Ashok Kumar Pandey, J) Shubham/- U T
