The petitioner apprehends his arrest in connection with Guraru P.S. Case No.62 of 2014 registered under Section 47(A) of the Excise Act.

The accusation is that on seeing the police personnel, the petitioner, who was driving the motorcycle, fled away leaving behind his motorcycle there. On search of the motorcycle, 70 pouches, each containing 200 ml. country made wine, were recovered from a bag, kept in the motorcycle. Learned counsel appearing on behalf of the petitioner submits that there was composite wine shop, the licence of which

No.44176 of 2016 (2) dt.24-10-2016 2/2 was in the name of Kiran Devi, the wife of the petitioner, for the year 2014-15 and the country made wine, which is said to be recovered from the bag, kept in the motorcycle, was of shop of the wife of the petitioner. Further submission is that the petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Guraru P.S. Case No.62 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
