JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2021 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of regular bail, arises out of Ariyari (Kassar O.P.) Police Station Case No. 204 of 2018, disclosing offences under Sections 304(B), 12(B), 201, 34 of the Indian Penal Code.
Prosecution story as per the FIR is that petitioner along with other co-accused persons committed torture and killed the daughter of the informant due to non-fulfillment of demand of dowry. Petitioner is father-in-law of the accused. It is submitted on behalf of the petitioner is that the main accusation of torture is against the husband of the deceased. The petitioner lives separately in mess and business from the husband of the deceased. It is also submitted that the
Patna High Court CR. MISC. No.38781 of 2021(2) dt.13-12-2021 2/2 husband of the deceased is in jail. Petitioner is in custody since 09.12.2020. Investigation is complete and charge-sheet has already been submitted.
Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 09.12.2020, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura, in connection with Ariyari (Kassar O.P.)
