The petitioner apprehends arrest in Madhepur (Lakhanaur) P.S. Case No. 165 of 2003 instituted for the offence under Sections 366,379/34 of the IPC.
As per the complaint, the married daughter of the informant has gone outside village and petitioner and other accused person with conspiracy kidnapped the minor daughter of the informant. It is mentioned in the impugned order that this petitioner has been declared absconder in Sessions Trial No. 332 of 2004 and in spite of providing several opportunities, he did not appear.
Learned counsel for the petitioner submits that case has now been compromised between the parties.
Patna High Court Cr.Misc. No.28554 of 2018(2) dt.18-05-2018 2/2 The petitioner has been already declared absconder. Therefore, this court is not inclined to grant anticipatory bail to the petitioner.
Accordingly, this anticipatory bail petition stands rejected.
The petitioner is directed to surrender in the court below within four weeks from today and seek regular bail which will be considered by the court below in accordance with law, without being prejudiced by this order.
