This application for anticipatory bail, arises out of Matihani Police Station Case No. 166 of 2017, disclosing offences punishable under Sections 467, 468, 471, 420, 120(B)/34 of the Indian Penal Code.

The petitioner is said to have secured appointment on the basis of certificates as Panchayat Teacher, which were subsequently found to be forged.

Learned counsel for the petitioner states that the petitioner is no more in service as her service has been terminated. It has also been argued that since the case against

Patna High Court CR. MISC. No.28344 of 2019(2) dt.30-04-2019 2/2 the petitioner is based on documentary evidence, there is no chance for the petitioner to tamper with the evidence. Considering the facts and circumstances and submission so advanced, this application is allowed. Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the Sri Junaid Alam, learned Judicial MagistrateI, Begusarai in connection with Matihani Police Station Case No. 166 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
