The petitioner apprehends his arrest in Complaint Case No.1689 of 2016 registered under Section 406 of the Indian Penal Code and under Section 138 of Negotiable Instrument Act.

The learned counsel for the petitioner submits that petitioner is said to have issued a cheque of Rs.2,65,613/- but the cheque was dishonoured. The petitioner is ready to return the entire amount within four months.

Taking into consideration the facts aforesaid that the petitioner is ready to return the entire amount within four months from the date of receipt of this order, let the petitioner,

Patna High Court CR. MISC. No.28199 of 2020(3) dt.11-12-2020 2/2 above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Supriya Jaiswal, learned Judicial Magistrate 1st Class, Patna in connection with Complaint Case No.1689 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

If the petitioner fails to return the entire amount i.e. Rs.2,65,613/- to the complainant within four months from the date of receipt of this order, the learned court below shall cancel the bail bond of the petitioner immediately after lapse of four months.
