JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Town P.S. Case No. 602 of 2016 registered under Sections 272, 273 of the Indian Penal Code and section 47 of Bihar Excise Act.

The accusation is that in course of checking the vehicles at Hari Sabha Chowk, Muzaffarpur, one Sumo Gold vehicle, bearing no. BR06PC/9286, was apprehended by the Police, but the driver succeeded to flee away. On search, 60 bottles of Indian made Foreign Liquor, each containing 750 ml. and also 40 bottles, each containing 180 ml. of Indian made Foreign Liquor recovered from the vehicle.

No.53281 of 2016 (2) dt.08-12-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner had purchased the Sumo Gold vehicle for commercial use for livelihood and handed over the vehicle to the driver, Roshan Kumar, for driving on road but he misused the vehicle carrying illicit liquor in collusion with some liquor businessman. Further submission is that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Muzaffarpur in connection with Town P.S. Case No. 602 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
