The petitioner apprehends her arrest in connection with Deo P.S. Case No.36 of 2016 registered under Sections 419, 420 and 406 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Aurangabad.

The accusation is that the petitioner being the then Mukhiya of Gram Panchayat-Dulare in collusion with Late Binod Paswan, the then Panchayat Secretary, grabbed Rs.45,39,776/- without completing the work. In spite of giving notice by the District Magistrate, the petitioner did not deposit the aforesaid amount in the Block Office-Deo.

No.46129 of 2016 (3) dt.14-12-2016 2/2 Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within six weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
