JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Aurangabad P.S. Case No. 123 of 2017 for an offence under sections 379 and 411/34 of the Indian Penal Code and Section 3(2)(E) of Damage of Public Property Act.

Counsel for the petitioner submits that the petitioner is owner of the truck bearing no. JH-2-AG-7358. It is alleged that the truck was used for transportation of stolen sand. Counsel for the petitioner submits that neither he was involved in the business of alleged stolen sand nor in any manner connected with the illegal activities of business of sand and he figures in this case only because he is owner of the truck.

No.53698 of 2017 (2) dt.15-11-2017 2/2 Considering the aforesaid submission of the counsel for the petitioner, let the petitioner, named above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Mufassil P.S. Case No. 123 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
