====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Ishakchak P.S. Case No. 193 of 2018, instituted for the offence under Section(s) 394 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence when the informant along with his friends Amit Kumar and Abhinit Srivastava was going to Gumti No.1, three miscreants surrounded him on railway line and on the point of dagger looted money and golden chain from him. The informant raised hulla, then the accused persons hit him with stone. The informant and his friends claim to have identified the petitioner and other accused as named in the written report.
Patna High Court CR. MISC. No.26997 of 2019(3) dt.26-04-2019 2/2 Learned Sessions Judge has mentioned in the impugned order that money has been recovered from possession of the petitioner along with knife. Counsel for the petitioner submits that No Test Identification Parade of aforesaid articles has been held. Charge sheet has already been submitted against the petitioner. Petitioner is in custody since 27.9.2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Ishakchak P.S. Case No. 193 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
