Petitioner seeks bail, who is in custody since 06.02.2023, in connection with Bikramganj P.S. Case No. 53 of 2023, F.I.R. dated 05.02.2023 registered for the offences punishable under Sections 448, 307, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he fired upon the daughter of the informant due to which she sustained bullet injury on her waist.
Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has been falsely implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the

Learned APP for the State, on the other hand, on the basis of material available on record and the case diary, vehemently opposed the prayer for bail and submits that there is direct and specific allegation against the petitioner that he has fired upon the daughter of the informant and the injury report of the daughter of the informant suggests that one bullet injury was found on the persons of the daughter of the informant. Considering the aforesaid facts that there is direct and specific allegation against the petitioner, I am not inclined to enlarge the petitioner on bail in connection with Bikramganj P.S. Case No. 53 of 2023 pending in the Court of learned Additional Chief Judicial Magistrate-1, Bikramganj, Rohtas. Prayer is refused.
