The petitioner apprehends his arrest in connection with Kusheshwar Asthan P.S. Case No. 280 of 2019 registered under Sections 341, 323, 354, 302 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. There is specific allegation against co-accused Sanjay Yadav. Further he submits that in the instant case, final form has already been submitted, as contained in Annexure-3 to the bail application.

Having considered the facts and circumstances of the

No.28826 of 2023(2) dt.14-07-2023 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the S.D.J.M., Biraul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 280 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
