1. Heard learned counsel for the petitioner, the learned counsel appearing on behalf of the Vigilance and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that petitioner sought appointment as Teacher based on forged and fabricated certificates.
4. The learned counsel for the petitioner submits that prior to instituting of the FIR, the petitioner was not given any
Patna High Court CR. MISC. No.28491 of 2025(2) dt.07-05-2025 2/2 opportunity of being heard. It is submitted that had an opportunity been given to the petitioner to explain his side of the case, perhaps the FIR would not have been instituted.
5. Learned counsel for the Vigilance as well as learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari in connection with Chakiya P. S. Case No.06 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
