In this case, the petitioner is seeking regular bail in connection with Katoria P.S. Case No.13 of 2020 (G.R. No.12 of 2020), registered for the offence under Sections 4 of the POCSO Act.
Serious allegation has been made against the petitioner, who is uncle of the informant, that while the mother and sister of the informant had gone to Delhi in connection with treatment, the petitioner came to the house of the informant and committed rape upon her and also threatened her of dire consequences.
Patna High Court CR. MISC. No.25181 of 2020(3) dt.08-12-2020 2/2 Learned counsel for the petitioner submits that the real fact is otherwise as the petitioner saw the informant with a boy in comprising position in absence of her parent and only with a pressure to pressurize the petitioner, this false case has been lodged by the informant.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
