JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE ) Date: 25-01-2017 The grievance of the petitioner is in respect of construction of an underpass on Patna-Gaya road which is being converted into a four-lane National High Way.

2. As to whether at a particular road will require an underpass or an over bridge is a decision to be taken by the experts. Mr. S.D. Sanjay, learned Addl. Solicitor General, states that Ministry of Road Transport and Highways, Government of India, has approved the plan of construction of the underpass and that, in fact, the petitioner has been prompted by a petrol-pump owner who wants to set up a petrol-pump near the underpass.

3. In view of the fact that decision to construct the underpass is taken by the experts, therefore, in the writ jurisdiction,
