JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-03-2022 At the very outset, learned counsel for the petitioners is permitted to make necessary correction in para-1 of the petition. Heard leaned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 427, 452, 380, 386 and 504 of the Indian Penal Code.

The prosecution case is that when the informant started work of repairing the house, all the accused persons, who were neighbours, having armed with different weapons, came and obstructed the work. The informant made complaint before the Circle Officer and the SHO and the land was measured by Anchal

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that there is no specific allegation of assault against the petitioners and several accused persons have been granted anticipatory bail by different co-ordinate Benches of this Court. Petitioners have got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-III, Muzaffarpur in connection with Kudhani P.S. Case No. 746 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
