Mr. Anish Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend his arrest in connection with Fulwariya P.S. Case no. 43 of 2018, registered under Sections 342, 323, 504, 506, 308 and 379/34 of the Indian Penal Code.

The accusation is that on 14.02.2018 at about 8.00 P.M., informant, Rajendra Singh was at his furniture shop situated in Koyaladeva market. At that time, petitioners reached there boarding on vehicle and after getting down to the vehicle Dheeraj Tiwari (Petitioner No.2) pointed katta at his head and rest petitioners started wrapping Gamcha on the neck of informant and, thereafter, the informant was carried in west

Patna High Court Cr.Misc. No.28753 of 2018(2) dt.10-05-2018 2/3 direction causing assault. On raising alarm by the informant and making request, the informant was set free. At that time, Dinesh Tiwary snatched golden chain worth of Rs. 75,000/- and Dhrubdeo Singh took his wrist watch and also asked him for giving Rs. Two lakhs as ransom.

Learned counsel for the petitioners submits that, in fact, informant Rajendra Singh wanted to purchase three katha land of petitioners situated near his house, but petitioners refused. Due to that reasons, the petitioners were abused and assaulted regarding which Fulwariya P.S. Case No. 06 of 2018 is instituted against the informant of the present case and others under Sections 447, 384, 504, 506, 323, 379/34 of the I.P.C. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Fulwariya P.S. Case No. 43 of 2018, subject to the condition as laid down under
