The petitioner has preferred this application for grant of regular bail in a case registered under sections 384 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, on receiving information about rangdari being taken at the bus and tempo stand it is stated that a raid was conducted but the accused persons managed to escape. It is, thereafter, stated that the raid was conducted at the house of the accused Tinku Kumar where he was taken into custody and disclosed that he along with other accused persons including the petitioner herein works for contractor Ramesh Singh and extract rangdari in the parking area.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From the
Patna High Court CR. MISC. No.38886 of 2021(2) dt.12-01-2022 2/2 allegation in the FIR it would evident that the petitioner was not arrested at the spot. The only material against the petitioner is his name being taken by a co-accused in his statement before the police which is inadmissible. The main allegation is against Ramesh Singh who has himself been enlarged on bail vide order dated 2.3.2021 (Annexure-2) passed in Cr. Misc. No. 14319 of 2021. The petitioner is in custody since 15.1.2021 and chargesheet has been submitted in the case.
The application for bail is opposed by learned APP for the State who submits that the petitioner is accused in a number of criminal cases from before.
Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR together with the petitioner having remained in custody for about 1 year and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with G.R.P. Jehanabad (Taregna) P.S. Case no. 19 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Patna.
