Learned counsel appearing on behalf of the petitioner submits that petitioner was released on provisional bail vide order dated 19.10.2022.
Considering the statement made in paragraph no. 2 of the supplementary affidavit that final form has already been submitted in connection with Saraiya P.S. Case No. 318 of 2020 and the remark has been made by the Investigating Officer that he has submitted the final form as "Mistake of fact" before the learned Court below. He further submits that subsequent to the present case, the petitioner has been made accused in Saraiya
Patna High Court CR. MISC. No.28642 of 2022(5) dt.16-11-2022 2/2 P.S. Case No. 318 of 2020 for offences punishable under Section 302/34 of the Indian Penal Code while he was in custody. He further submitted that nothing was recovered from the possession of the petitioner rather the recovery was made from a container which was seized near Pakki Sadak in village Chakiya.
Considering the aforesaid fact, the provisional bail granted to the petitioner vide order dated 19.10.2022 is confirmed on similar terms and conditions as mentioned in the said order.
Accordingly, the present bail application is disposed of.
