Patna High Court Cr.Misc. No.31622 of 2018 (3) dt.18-06-2018 2/3 18-06-2018 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in Mahua P.S.Case No. 257 of 2016 registered for offences punishable under Sections 147, 149, 341, 323, 353, 427, 504 and 506 of the Indian Penal Code and 3 of Public Property Damage Act. Accusation is that on 29.6.2016 at about 9.45 P.M.61 persons named in the F.I.R. and two hundred unknown blocked the road in protest of lodging of Mahua P. S. Case No. 249 of 2016 against named accused at the instigation of Shashi Kumar Rai Mukhiya and Shashi Kumar Rai, Chairman PACS. The mob entered into campus of police station and started to damage vehicles, chairs and CCTV camera. The informant, being a police officer along with other police officials tried to pacify the situation but they started pelting stones and burn tire.

Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. along with others but no specific allegation has been made against the petitioners. Further submissions is that Gaurav Kumar and twenty seven other named in the F.I.R. have already been granted privilege of pre-arrest bail by a Co-ordinate Bench of this Court vide order dated 05.04.2018 passed in Cr.

No.31622 of 2018 (3) dt.18-06-2018 3/3 Having considered the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each in connection with Mahua P. S. Case No. 257 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, subject to the condition laid down under Section 438 (2) of the Criminal Procedure Code.
