Petitioner is in custody in connection with Motipur P.S. Case No. 1042 of 2018 for the offence under sections399,402, 307, 414 and 353 of the Indian Penal Code and Section 25(1-a)b/26/27/35 of the Arms Act. Learned counsel for the petitioner submits that allegation against this petitioner is that one country-made pistol was recovered from the possession of the petitioner. Learned counsel submits that petitioner has no criminal antecedent.

The petitioner is in custody since 1.1.2019.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for three months,
