Petitioner was granted anticipatory bail in Cr. Misc. No. 17699/2016 vide order dated 03.05.2016 in connection with Sikarhatta P.S.Case No. 13/2016 pending in the court of learned Sub Divisional Judicial Magistrate, Ara, Bhojpur. Earlier a modification application Cr. Misc. No. 33377/2016 was filed by the petitioner for modification of the said order wherein inadvertently the petitioner had been stated to be the owner of the truck bearing Registration No. JH-01AE-5356 in question whereas he was just a driver of the said truck, which modification was allowed vide order dated 10.08.2016. The present application has been filed for further extending the period of surrender before the Court below as period of surrender as granted by this Court in Cr. Misc. No. 17699/2016 vide order

Patna High Court Cr.Misc. No.45548 of 2016 (2) dt.19-10-2016 2/2 dated 03.05.2016 has already expired.

Under such circumstances, the time granted under order 03.05.2016 passed in Cr. Misc. No. 17699 of 2016 for surrender and furnishing bail bonds is extended for further eight weeks from today. The said order is modified only to the extent indicated above.

With this observation this modification application is allowed.
