The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/148/354/379/427/448/504/506 of the Indian Penal Code. The prosecution case got initiated on the basis of written report dated 04.01.2018 submitted by Bangali Yadav to the Station House Officer, Arwal Police Station is to the effect in pursuance to an order passed in 144 Cr.P.C. proceeding, the petitioner was fixing pillars and erecting walls over the land in question. On 04.01.2018, at 2.00 P.M, all the accused persons,

Patna High Court Cr.Misc. No.30668 of 2018(2) dt.18-05-2018 2/3 including the petitioners, came and started abusing the informant. Thereafter, on the order of co-accused Lok Nath Singh, the petitioners and other co-accused persons demolished the wall. It is further alleged that petitioner no.1, Janardhan Yadav took out Rs.5000/- from the pocket of the informant It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation has been levelled. Accusation is omnibus and general. Moreover, co-accused Lok Nath Singh has been granted anticipatory bail vide Criminal Miscellaneous No.18450 of 2018. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent.

It is submitted by learned APP for the State that the petitioners are named in the FIR.

Considering the genesis of the occurrence, coupled with statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Arwal in
