Earlier the lands of petitioner were acquired for construction of drainage but neither compensation was paid nor possession was taken as per averments made in counter affidavit filed on behalf of respondent no. 7. However, it is admitted by respondent no. 7 in counter affidavit that previous acquisition proceeding has already been lapsed in view of New Land Acquisition Act.

Therefore, in the aforesaid circumstance, in my view,

Patna High Court CWJC No.16335 of 2014 (2) dt.12-09-2017 2/2 this writ petition does not have any merit and, accordingly, this writ petition stands disposed of.
