Petitioners are apprehending their arrest in a case registered for offences punishable under Sections 323, 341, 307, 353, 379, 427, 504 and 506/34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that even on a bare perusal of the First Informant Report, this case does not appear to be a case of Section 307. Petitioners have been falsely implicated in this case as they had complained about the bad behaviour of the concerned teacher.
Heard learned A.P.P. also.
Considering the submission, as above, and the fact that the petitioners have no criminal antecedent, this application is
Patna High Court Cr.Misc. No.45445 of 2016 (2) dt.15-12-2016 2/2 allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar, in connection with Sheohar P.S. Case No. 89 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
