17-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, in the present case, is seeking anticipatory bail in connection with Laukahi P.S. Case No. 48 of 2015, G.R. no. 5751/2015, for the offences under Sections 323, 342, 468, 384 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the whole case of the informant is that this petitioner has executed a sale deed in respect of a land which fell in the share of the informant in partition suit no. 142/1951. Learned counsel submits that the land sold by this petitioner was his self acquired property which he had purchased by virtue of a registered sale deed in the year 1971. Learned counsel
Patna High Court Cr.Misc. No.50609 of 2017 (2) dt.17-10-2017 submits that in the nature of the dispute the petitioner deserves the privilege of anticipatory bail.
Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the nature of allegation, in the event of his arrest/surrender before the court below within a period of four weeks, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur, Madhubani, inc connection with Laukahi P.S. Case No. 48/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
