2. The petitioner seeks regular bail in the present case registered for the offence under Sections 304B, 120B/34 of the Indian Penal Code.
3. As per the prosecution case, due to non-fullfilment of demand of dowry, the deceased has been killed by the petitioner and his family members.
4. Learned counsel for the petitioner submits that petitioner is the husband of the deceased and is in custody since 08.06.2023. He further submits that there is no external injury found on the body of the deceased. Viscera report has been preserved. No witness has been examined in the trial.
5. Learned A.P.P. has vehemently opposed the prayer
Patna High Court CR. MISC. No.31104 of 2024(4) dt.18-09-2024 2/2 for bail.
6. Considering the period of custody and the delay in trial, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.D.J-V, Katihar /concerned Court below in connection with S.T. No. 667 of 2023 arising out of Azamnagar P.S. Case No. 191 of 2023 subject to condition that:- 7(i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court through himself or through his lawyer.
