====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 09-11-2017 Heard learned counsels for the petitioner and the State.
The petitioners apprehend their arrest in connection with Dinara P. S. Case No. 35 of 2017 instituted under Sections 147, 148, 149, 307, 323, 324, 325, 447 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation in brief is that all accused persons assaulted the informant and his family members and the specific allegation is against Raj Vansh Singh of giving a spear blow on the person of the informant.
Learned counsel for the petitioners submits that both sides are agnates and there is case and counter case due to land dispute and the police, after investigation, submitted final form
Patna High Court Cr.Misc. No.52870 of 2017 (2) dt.09-11-2017 2/2 and there is no injury of any spear blow on the person of the informant and these petitioners have no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioners, namely, Raj Vansh Singh, Manji Singh and Amarendra Kumar @ Amarendra Kumar Singh, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Mr. Lal Bihari Paswan, Judicial Magistrate, 1st Class, Bikramganj, Rohtas in connection with Dinara P.S.Case No. 35 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
