2. The petitioner has preferred this application for grant of regular bail in connection with Saharsa Sadar P.S. Case No. 714 of 2023 dated 10.10.2023, registered for the offences punishable u/ss 302, 304B, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and other co-accused persons are alleged to have killed the daughter of the informant by strangulating her neck due to non-fulfillment of the demand of a motorcycle as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no criminal antecedent as stated in

Patna High Court CR. MISC. No.31204 of 2024(2) dt.01-05-2024 2/2 para 3 of the bail petition. The petitioner is bhaisur of the deceased. The petitioner never demanded any dowry nor tortured the deceased. There is a delay of two days in lodging the F.I.R. and there is no plausible explanation for the same. There is general and omnibus allegation against the petitioner. The husband of the deceased is already in judicial custody. The petitioner is in custody since 11.10.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the allegation being general and omnibus against the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saharsa in connection with Saharsa Sadar P.S. Case No. 714 of 2023.

7. The application stands allowed.
