Learned counsels for the Bank as well as the State are present. Having gone through the order, in our view, the appeal has become infructuous.
The writ petition was filed challenging action of the Bank in seizing the Tractor and auctioning the same which Tractor had been financed by the Bank and the writ petitioner had to pay the installments of the loan. The Tractor having already been auction sold and the third party
Patna High Court LPA No.1316 of 2012 dt.24-03-2015 2/2 right has been accrued and the amount having been adjusted to the outstanding liability, we see no reason to interfere with this appeal. Accordingly the same is dismissed.
