Heard learned counsel for the petitioner and learned A.P.P. appearing on behalf of the State. 2.
The petitioner apprehends his arrest in connection with Shahjahanpur P.S. Case No. 78 of 2022 corresponding to P.T. No. 3119 of 2022 registered under Sections 366 (A) and 34 of the Indian Penal Code. 3.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the first information report has been lodged after two weeks. The victim girl in her statement recorded under Section 164 of the Cr.P.C. has clearly stated that she herself went to her sasural and the Court below had assessed her age 18 years, as contained in Annexure-3 to the bail application. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Judicial Magistrate-I, Patna City, Patna in connection with Shahjahanpur P.S. Case No. 78 of 2022 corresponding to P.T. No. 3119 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) utkarsh/- U T
