JUSTICE SANDEEP KUMAR ORAL ORDER 21-06-2024 This is the second attempt of the petitioner for grant of regular bail as earlier the application of the petitioner for grant of regular bail was rejected vide order dated 24.05.2023 passed in Cr. Misc. No. 28295 of 2023.
2. The following order was passed on 24.05.2023:- "Heard the learned counsel for the petitioner and learned counsel for the State.
Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with G.R. No.440 of 2023 arising out of Sultanganj P.S. Case No. 54 of 2023 registered for the offence under Sections 302/120(b)/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner and other co-accused were hired to kill the deceased for a petty dispute at the instance of the petitioner. The petitioner is in custody since 27.01.2023.
Learned A.P.P. has vehemently opposed the prayer for bail.
In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner because he is a
Patna High Court CR. MISC. No.34152 of 2024(2) dt.21-06-2024 2/2 contract killer.
Accordingly, the prayer of bail of the petitioner is rejected herewith.
The trial Court is directed to expedite the trial of all the cases in one court pending against the petitioner."
3. Learned counsel for the petitioner submits that the trial is being delayed and therefore, the petitioner may be granted bail.
4. The petitioner is a hired criminal and he has committed the crime.
5. In view of the above, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this application is dismissed.
7. The trial is directed to take all steps for early conclusion of the trial of the petitioner.
